SEMINAR " LEGAL STATUS OF THE CHARTER OF

FUNDAMENTAL RIGHTS OF THE EUROPEAN UNION"

For Your presentation:

Please choose one judgment, or Draft Recommendation for 10-15 minutes long presentation that should include the following parts:
a) the facts of the case;
b) why was the reference made to the Charter of Fundamental Rights of the European Union.

You can find the judgments of the Court of Justice of the European Union (CJEU), the General Court, and the Civil Service Tribunal, for instance, from the Library of the University of Tartu, from EUR-Lex, or on the site of the CJEU.

You can find the judgments of the European Court of Human Rights from the Juridicum Library, from the Library of the University of Tartu, or on the site of the European Court of Human Rights (HUDOC database: http://www.echr.coe.int/ECHR/EN/Header/Case-Law/HUDOC/HUDOC+database).

Please be careful when using the electronic search forms - Try not to mix the Charter of Fundamental Rights of the European Union up with the Charter of Fundamental Rights in Czech Republic's domestic legal order, etc.!

You can find the Draft Recommendations of the European Ombudsman from the site of the European Ombudsman: http://www.ombudsman.europa.eu/home/en/default.htm

If You, for example, happen to select a judgment of the CJEU, where an Advocate General has made a reference to the Charter of Fundamental Rights of the European Union, but the reference has not been supported by the judge, You may also discuss the question why has the judge not supported the opinion of the Advocate General, etc.
